There were allegations of a criminal breach of trust on our patron. For this, the law can punish him for a maximum period of 3 years. The IO had not served the mandatory notice to our patron before arresting him. Also, the way he made the arrest was not justifiable. Our patron’s complaints to the police were not being responded to.
The police officer high-handedly approached the matter. He had breached the directions passed by the Supreme Court in Arnesh Kumar v. State of Bihar. The way he handled the case was in specific breach of these guidelines of the Supreme Court. Contempt proceedings are essentially initiated if the mandatory notice for arrest is not served upon the person upon whom the arrest will be inflicted. There was a clear breach of law.
Our patron suffered humiliation out of the arrest. His family had felt the shame and embarrassment of arrest, too. No reasons given to his neighbours and all those who would have seen his arrest can undo the humiliation suffered by him and his family.
The court held that our patron lost his reputation, and it also compromised his personal liberty for 11 days,and is out on bail.
The court held IO guilty of Contempt of Court.
