Initially, the wife went to take care of her ill mother but didn’t come back to her matrimonial house.
While being at her mother’s house, she conspired with several unknown people for the sake of extorting money from her husband. This eventually dishonoured his dignity, too.
His mother had suffered a brain stroke. She was completely dependent on her son. He was unable to leave her and live somewhere else. His wife and his in-laws were continuously pressurizing him to become resident son-in-law (Ghar Jamai).
Subsequently, the wife filed for divorce case against him demanding permanent alimony worth 50 lakhs and a monthly maintenance to tune of of Rs. 1 lakhs.
Husband, being shocked by her decision, tried to settle the matter out-of-court. Since it became a big issue, he had to record his telephonic conversations with the wife and her family.
The conversation between the mediator and the wife’s paternal uncle was recorded with the due permission of her paternal uncle. Husband was continuously being provoked to come and stay at his in-law’s house and her family side tried to extort money from him.
After a gap of 21 months, she had filed for the maintenance. In this case, she had frivolously alleged that she was harassed for dowry and wrongfully confined, physically harassed, assaulted, and threatened. She also alleged that her Stridhan was taken away, and they did not give her food and medicines. And that he used to provoke the family members to beat her and he didn’t allow her to meet her family members. She had also alleged about the conspiracy and that he had thrown her out of the house.
However, she had not made the above-mentioned allegations against her husband while filing the divorce case. She levelled these false allegations against him, only to threaten him and to extort money from him.
Husband registered an FIR against her under IPC 384,388,506,120B for extorting money from him. She demanded 50 lakhs from the husband.
