We helped one of our patrons in a matter wherein he was asked exorbitant maintenance worth Rs. 70,000 by his wife under Section 125 of the CrPC. She was demanding maintenance for herself and her minor child despite being highly qualified, having good source of income. Earlier she had demanded Rs. 20 lacs alimony too.
The Petition was filed by the wife for maintenance and for the litigation expenses.
Allegations were made against our patron that he was drawing a salary of Rs. 80,000 per month along with health insurance for his family members. It was also alleged that he is getting a family income from his ancestral property, that his father is drawing pension amounting to Rs. 45,000 and his
total family income amounting to the tune of Rs. 2,00,000 per month. The wife was already in job for an organisation drawing salary to the tune of Rs. 50,000 and she was also running a boutique with a monthly income not less than Rs. 35,000.
The husband, on the other hand, was pursuing LLB, he had to pay his college fee, he was having the responsibility of the aged parents, he had to pay the rent of his rented accommodation, his LIC policies as well as the litigation expenses due to the cases filed by his wife.
Whereas the wife was already well qualified, was drawing a good amount of salary along with additional income from her boutique. The court found that she had lied in her affidavit about her income and held that she is not entitled to any maintenance in addition she has to also share maintenance for the child.
