The wife and her father had stolen valuable articles from the husband. They had also committed a criminal breach of trust against him. Despite all this, the police were not filing FIR against them at the behest of the husband. Even it was not filed on reaching the higher officials.
IO had filed the report. He had alleged that the husband had made the complaint after a gap of 35 days. As per him, he made the complaint to build pressure against the wife and her father. He also stated that since the theft accused is his wife, she had the right to move in and out of her matrimonial house.
The court accepted that an offence of theft under S. 379 and S. 406 for criminal breach of trust had been committed by them, respectively.
The court directed the SHO to start an investigation on the complaint after registering a due FIR.
