An application for grant of bail in a false rape case was filed by one of our patrons. He had contended that the relationship with the complainant was consensual.
Both the complainant and the accused had met in Ajmer, Rajasthan which turned out to be a romantic relationship thereafter. Both of them visited several places together including hotels. Photographs of both were annexed in the bail application. The marriage perspective was sought after by the family of the complainant. Thereafter their Roka ceremony was fixed on a due date. However, differences erupted between both of them and the complainant wanted to end the relationship. It was shared by the complainant on the day of Roka only.
Families of both parties had words with each other two days later and the gifts received by the family of the applicant were returned. Due to a vendetta, an FIR was lodged against the accused. She had alleged that physical relations were established with her forcefully by the accused citing their due marriage shortly. It was claimed by her that she had informed about this to the parents of the accused but they ignored that. She further alleged that she had got pregnant but she was given contraceptives by the accused. And she didn’t disclose this fact and claimed that her objectionable photographs were taken by the accused and he had allegedly threatened her to make them viral. Thereafter alleged continuous forced physical relations were established by the accused with her at several places including hotels. She claimed that she repeatedly told about such to his parents, who purportedly ignored them and threatened her instead. And that after the Rokka, car, gold, and cash were allegedly demanded by the applicants’ family. And that since the father of the complainant was not able to deliver these items, the family of the accused cancelled the marriage and threatened her family.
However, in the reply to the bail application, the statement given by the prosecutrix did not support the complaint filed by her. As per the statement, she had agreed that the relationship between them was consensual and their families had agreed for their marriage too. Since the accused and his family had refused to marry her, she lodged FIR against him.
On our contentions presented, the court agreed that both were in a consensual relationship. Both had visited several places and stayed in hotels together. Court stipulated that the complainant is a resident of Alwar, Rajasthan, working in Delhi as a Sales Executive and is mature enough to understand the consequences of her acts. The court on perusal of the records held the relationship to be consensual. It also apprised the fact that as something went wrong after the Roka ceremony the complainant filed the FIR. The court was subsequently convinced on behalf of the accused that lead him out on bail.
