Discharge in 498A of Husband from Trial Court upheld by Sessions Court
Ravinder was facing false persecution under 498A in Delhi, we advised that the case is fit for discharge and asked him to wait till Chargesheet before doing anything. When chargesheet was filed, it was advised that an application for discharge be moved in the trial court. The trial court after extensive arguments discharged the husband of all offences including 498A.
Here is the order of the trial court:
The lady moved Session Court against the said order of the Trial Court, the Session Court upheld the decision of the trial court and refused the prayer of the complainant to put the husband on 498A trial again.

Hi,
My wife filed a CC under acts 498A,377,494,323,504,506,34 against me and my family in 2021. Chargesheet has been filed and all accused are on bail. I filed a DV in 2022 and now the complainant has agreed to Divorce on Mutual consent and she has agreed to support/withdraw the allegations in court.
I want a discharge. Is it possible from trial court (sessions court) or should i approach High court?
A quick response will be appreciated.
You should get the 498a quashed from High court and move ahead in life.
