Status report reveals that the petitioner and the prosecitrix were acquainted with each other – Physical relations were established on several occasions between them. The prosecutrix is married and a major lady. Bail granted to petitioner.
JUDGEMENT
1. The petitioner seeks regular bail in case FIR No. 631/2015 under Sections 376/328/506 IPC registered at Police Station Vikas Puri. Status report is on record. I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 05.07.2015. Charge-sheet has since been filed. Status report reveals that the petitioner and the prosecutrix were acquainted with each other. Physical relations were established on several occasions between them. They even traveled to Amritsar and made physical relations there. There is a delay of about more than two months in lodging the FIR. The prosecutrix was major and a married lady.
2. Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of the Trial Court with the direction that he shall not contact the prosecutrix and endeavour to criminally intimidate her and other prosecution witnesses in any manner The applications stand disposed of Order dasti.
