Success Story : Manish Singh acquitted of False 498a/ 406 Case
Background : Adversity does not build character, it tests it. Manish Singh is a epitome of what a fighter should be. The simple background of this case is that Manish had a bad marriage and then he had a brain stroke due to tensions and all. The wife sensing opportunity re-entered his parents house sensing danger to his life and when Manish was showing signs of health imporvements, filed a 498a/ 406 case against him and his family members in Rewari, Haryana.
Defence : Manish started his defence by learning the tricks at many men’s rights forums. He has been a regular at men’s rights meetings of various groups in Delhi. But he was not content on learning, he applied the learnings in real life. He filed Tax Evasion Petition and RTIs to get information about the income of the father-in-law and which ultimately helped him prove the innocence in court.
He also joined law to learn the nuances of law and the maker of this site had pleasure of preparing the cross-examination of prosecution witness along with written agruments for CrPC 319 application that his wife filed during trial and also the arguments of defence.
Below acquittal judgment in less than 4 years since institution of 498a is a shining example of “If you have to go through hell, keep moving”. The legal fights can be finished by facing them and not avoiding them
Footnote: Manish Singh is still fighting DV Case and is planning counter-action against the de-facto complainant and her family members.
